Use of artificial intelligence
What is produced by artificial intelligence, what that means for the result, and what you confirm by uploading material.
Before the first generation
Before the first generation you confirm that you understand: the result is produced by artificial intelligence, is probabilistic, and needs checking before publication.
We do not guarantee that the result is unique or that it does not resemble third-party material. It may not meet expectations, a particular marketplace's requirements, or advertising law. Checking the result before publication is the user's responsibility.
On every result
Every file the service delivers carries a statement that a model made it: an XMP packet naming the IPTC digital source type for synthetic media, and the same sentence again in EXIF. Two records, because a marketplace's upload tool reads one and the seller's desktop viewer reads the other. In the API every result carries an AI-generated flag.
That is a description of the file, not provenance. The marking is plain text in the file, so a metadata editor, a re-encode or a screenshot removes it, and the service cannot tell a file whose marking was removed from one that never had it. Tamper-evidence needs a signed C2PA manifest with a certificate chain - C2PA is not implemented here, and we do not write that it is.
Metadata in the photographs you upload is removed on the way in - including the GPS fix in a phone photo. Marking a picture taken on a camera as AI-generated would be both false and a privacy failure: we do not trade your files' privacy for a label.
Images of people
By uploading an image of a person you confirm that you have that person's consent.
Generating images of public figures, or of minors without the consent of their legal representatives, is forbidden.
Rights
The rights to the result pass to the user for commercial use without crediting the service, to the fullest extent the law allows.
By uploading logos and design elements you warrant that you hold the rights to them.
Advertising marking
If the result is used in advertising, the erid marking obligation rests on the user. The service warns about this in the interface but does not file the marking for you.
